Terms of Service for Fasti: Fasting Tracker & Timer

Welcome to Fasti: Fasting Tracker & Timer ("App"), operated by Stellar Apps, LLC ("Company," "we," "us," or "our"). By accessing or using our iOS mobile application, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use our App.

1. Acceptance of Terms

By using the App, you agree to these Terms. If you are using the App on behalf of an organization, you agree to these Terms on behalf of that organization.

2. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the App. Your continued use of the App after any changes indicates your acceptance of the new Terms.

3. User Accounts

You may need to create an account to use some features of our App. You are responsible for safeguarding your account credentials and for all activities that occur under your account. We use Firebase Authentication to manage user accounts, and you agree to comply with Firebase's terms of service. We are not liable for any loss or damage arising from your failure to protect your account.

4. Subscriptions

Fasti offers premium subscription plans that provide access to additional features:

  • Fasti+ Annual: $69.99/year for a 12-month subscription period
  • Fasti+ Monthly: $9.99/month

Both subscription plans will automatically renew at the end of each subscription period unless you cancel before the renewal date. You can manage your subscription, including cancellation, through the App Store app on your iOS device. To cancel your subscription:

  1. Open the App Store app on your iOS device
  2. Tap on your profile icon in the top right corner
  3. Tap on "Subscriptions"
  4. Select your Fasti subscription
  5. Tap "Cancel Subscription"

If you cancel your subscription, you will continue to have access to the premium features until the end of your current billing period. After that, your access will revert to the free version of the App.

5. Use of the App

You agree to use the App only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the App. You agree not to:

  • Use the App in any way that violates any applicable law or regulation.
  • Attempt to gain unauthorized access to the App or its related systems.
  • Interfere with or disrupt the App or servers connected to the App.
  • Use the App to transmit any malicious code or harmful content.

6. Intellectual Property

All intellectual property rights in the App and its content are owned by or licensed to Stellar Apps, LLC. You may not use any content from the App without our express written permission.

7. User-Generated Content

If the App allows you to post, upload, or share content, you retain all rights to your content, but you grant us a non-exclusive, royalty-free, worldwide license to use, store, copy, modify, and display that content in connection with the App.

8. Third-Party Services

The App uses Firebase Authentication and Firebase Analytics, which are third-party services provided by Google. Your use of these services is subject to Google's terms of service and privacy policies. We are not responsible for the practices of these third-party services.

9. Disclaimer of Warranties

The App is provided 'as is' and 'as available' without any warranties of any kind, either express or implied. Stellar Apps, LLC disclaims all warranties, including without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, Stellar Apps, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of or inability to use the App.

11. Indemnification

You agree to indemnify and hold harmless Stellar Apps, LLC and its employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) related to your use of the App or violation of these Terms.

12. Termination

We may terminate or suspend your access to the App at any time, with or without cause or notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

13. Governing Law

These Terms are governed by the laws of the United States without regard to its conflict of law principles.

14. Apple App Store Terms

You acknowledge that these Terms are between you and Stellar Apps, LLC, and not with Apple Inc. Apple is not responsible for the App or its content. You acknowledge that Apple Inc. is not responsible for addressing any claims you have or any claims of any third party relating to the App or your possession and use of the App. Your use of the App must comply with the App Store Terms of Service.
